Exploring the Different Types of Marriages in South Africa

When it comes to getting married, it’s essential to have a clear understanding of the options available to you. South Africa recognizes three types of marriages, each with its own unique characteristics. So, before you start planning your big day, let’s take a closer look at these different types of marriages.

1. Customary Marriages

According to the Department of Home Affairs, a customary marriage in South Africa refers to a marriage that is “negotiated, celebrated, or concluded according to any of the systems of indigenous African customary law which exist in the country.” It’s important to note that this definition does not include marriages performed according to Hindu, Muslim, or other religious rites.

In order for a customary marriage to be recognized as valid, it must have been entered into before November 15, 2000. However, if the marriage was entered into after this date, it must meet the following requirements:

  • The marriage must be negotiated, entered into, or celebrated in accordance with customary law.
  • The prospective spouses must both be above the age of 18 years.
  • Both prospective spouses must give their consent to the marriage.

2. Civil Unions

The Civil Union Act allows for individuals of any sexual orientation to enter into a legally recognized marriage through a civil union, civil marriage, or customary marriage. Civil unions can be conducted by designated marriage officers for specific religious denominations or organizations, as well as officers employed by the Department of Home Affairs and the Magistrates’ Courts.

3. Civil Marriage

A civil marriage, commonly practiced in South Africa, is a marriage between a man and a woman. This type of marriage can be further divided into three categories:

  1. Marriage out of community of property
  2. Marriage out of community of property with accrual
  3. Marriage in community of property (if not stipulated otherwise)

It’s important to note that if no specific arrangements are made, a civil marriage will automatically be considered in community of property, unless an ante-nuptial contract is set.
